Client Information

This information is intended to assist you to maximize and economize your mediation experience.  My goal is to assist you to most comfortably and confidently participate in mediation. In mediation, do note, however, that you will be making all of the decisions. As mediator, I have no decision-making power. So, it is important for you to consider how you can prepare and participate in mediation.  Initially, be thinking about the things that you want to be sure to take care of in your mediated agreement.

How long will the mediation take and how much will it cost?

It is hard to predict with precision how long a mediation will take or how much it will cost. Total cost depends primarily on how agreeable everyone is. My hourly fee is $250/hr.  We are able to complete most agreements in 3-5 meetings of up to 2 hours each.  With added drafting time, the total cost tends to be between $2000 and $4000 for a comprehensive agreement.

What are our chances for success?

Based upon experiences in the past, you likely have a 90% chance of reaching agreement in mediation but this can not be guaranteed.

What if we don't reach agreement?

Even if you don't reach agreement, the mediation discussions and materials are confidential and will not be admissible in any court proceeding.

Who pays for mediation? 

This is up to you.  Sometimes medation fees are shared.  Sometimes, one participant pays.

What about individual attorneys?

I suggest that each participant develop a trusted relationship with an attorney to provide background information, individual advice and agreement review.  All clients are advised to have any mediated settlement reviewed by individual legal counsel prior to signing.

What else can I do to prepare?

Perhaps the most valuable thing you can do is to clarify your goals for our discussions and some specific suggestions for satisfying these goals.
